Established in 1992, the Toxics in Packaging Clearinghouse (TPCH) plays a key role in advocating for the ‘Model Toxics in Packaging Legislation’ across the United States, and in supporting and coordinating the regulation’s implementation.
Thanks to its successful advocacy, TPCH’s legislation on hazardous substances in packaging materials has become a reference for many regulations in the U.S. The current TPCH Model Legislation, adopted in 19 states, bans the intentional inclusion of cadmium, lead, mercury, and hexavalent chromium in any finished package or packaging component, while also limiting the total concentration of these four heavy metals to a maximum of 100 ppm.
On February 16, 2021, the US TPCH issued the 2021 update to the Model Toxics in Packaging Legislation.
⬛Control of PFAS (Perfluoroalkyl and Polyfluoroalkyl Substances): The sale or repackaging of packages or packaging components containing PFAS must not be detected in any package or packaging component.
⬛Control of Ortho-Phthalates: The sale or repackaging of packages or packaging components containing phthalates is prohibited, and the sum of non-intentionally added phthalates in any package or package component must be less than 100ppm (0.01%)
To comply with the latest regulations, packaging must be free from harmful substances like PFAS and phthalates. Since specific lists of these substances aren’t provided, the current guideline is to ensure total fluorine (TF) or total organic fluorine (TOF) values are below 100 ppm, confirming no intentional addition of PFAS. The recommended testing method is combustion ion chromatography (CIC), which measures fluoride ion content.
